These Terms and Conditions ("Terms") apply when you make an order through swapkaart.com and related pages ("Website") as a consumer ("You"). The terms constitute an agreement between you and "Born Studio B.V.", company number: 85246573, Piet Mondriaansingel 243, Diemen, the Netherlands("Swapkaart" or "we").

The terms are only applicable to you who are consumers and who make orders through the website. We kindly ask you to read the Terms and Conditions before further use of the website.

By making a purchase and using this website, you agree to the following terms.

"Swapkaart" reserves the right to end sales and any image and writing errors on the site, such as product description or technical specification, incorrect pricing, and price adjustments (such as changes in prices from suppliers or currency fluctuations), or incorrect information about inventory. "Swapkaart" is entitled to correct any errors and to change or update the information at any time. If an incorrect price has been specified for an item you have ordered, we will of course inform you of this and await your approval of the corrected price before continuing with the order. All image information on the website is for illustrative purposes only. Such illustrations can not be guaranteed to reflect the number of goods you receive or the exact appearance, features, or origin of the product.

PERSONAL INFORMATION

When you shop on our website, we will save some of your personal information in order to complete your purchase. You have the right to request access to your data and if any information is incorrect, you may have it changed or deleted. We may also use cookies, for example, to enhance your experience with this website.

RATES, FEES AND PAYMENT

Once we have received an order from you, we will send a confirmation to your email address. It is therefore important that you enter the correct information when making an order. We recommend that you save the confirmation to facilitate any contact with our customer service. Confirmation also represents your receipt of the purchase.

You can choose to pay by bank, credit card, or by invoice. "Swapkaart" is entitled to withdraw money already in connection with the order, unless invoice payment or other similar payment method has been chosen by you and approved by "Swapkaart". In case of an invoice or partial payment, our partner can make a credit statement. You will then be informed of this. "Swapkaart" reserves the right not always to offer all forms of payment, or change the payment method if what you selected for some reason does not work at the time of purchase.

Purchase by invoice administered by Plugnpaid, this service can only be used by customers in specific countries in Europe. When paying by bank or credit card, Plugnpaid and Stripe will clear all our bank transactions. "Swapkaart" itself does not store or manage any bank or credit card numbers.

"Swapkaart" may offer promotions on the website that have more favorable terms than those appearing in these "Terms", such as Discounts or extended cancellation rights. These more favorable terms apply as long as the campaign is active and for the specific goods specified by the "Swapkaart" in connection with the campaign. We reserve the right to withdraw such promotions at any time. Upon termination or withdrawal of a promotion, these Terms and Conditions apply without modification. Offers on specific products on the website are valid for a limited time and as long as the stock is sufficient.

DELIVERY AND DUTY

Items in stock are usually shipped within the number of working days stated on the website. Unless otherwise agreed, for example, In conjunction with the reservation of items not in stock.

"Swapkaart" liability for defects in connection with delivery is limited in accordance with the applicable delivery terms for the current delivery and the terms and conditions of these Terms.

Our liability to you for any losses or damages arising from your order on the website is limited to the total amount of your order. "Swapkaart" has no liability for indirect losses.

Swapkaart will not issue refunds for products purchased through other entities, such as distributors or retail partners.

We cannot be held responsible for items damaged or lost in return shipment.

In the event of your order being received in a faulty or damaged condition, please notify us as soon as possible after you have received your goods as no claim for a replacement can be made after fourtheen days.  

Any claims regarding damaged/defective items must be made initially by a written claim via email to info@swapkaart.com. Claim email must be accompanied with purchase documents with the indicated order number and product number.

Within European Union Purchasing

We will deliver your order to the delivery address given at the time you place your order.  Delivery will be made as soon as possible after your order is accepted dependent on the lead time of the product. Available stock is usually delivered to EU location within 14-30 working days, depending on the location. You will become the owner of the goods you have ordered when they have been delivered to you and full payment has been received.

Delivery dates acknowledged by Swapkaart internet shop are non-binding estimates only, based upon the best available information concerning transportation schedules. Estimated delivery dates will be considered as accepted by the buyer unless disagreement is notified to the Company in writing within seven days of order placement.  Special delivery conditions requested by the buyer should be given in writing at the time of order placement and will be considered by the Company and if necessary, conditions and charges may change accordingly.  From delivery or placement into storage all risks for the goods pass to the buyer.

Orders that include several different items or multiple quantities: the items will be grouped together and, when everything is ready, one delivery will be made.

Outside European Union Purchasing

For outside EU delivery charges please email us at info@swapkaart.com with the delivery address and the items you wish to order, and we will provide a quotation.  You must observe and comply with all applicable regulations and legislation. Orders might be subject to import taxes/fees, which are payable by customer.  Furthermore, please be aware that due to the high cost of shipping internationally the cost of delivery and return is not covered by Swapkaart internet shop under any circumstances and therefore purchases are entirely at your own risk.

All quotations for outside EU orders do not include transit insurance. The provision of transit insurance, if required, is the responsibility of the buyer.

Delivery Charges

Delivery charges for web-store orders are included in in price shown on this web site and are valid for European Union Deliveries.

Your delivery will be carried out by Swapkaart delivery partner.

Most deliveries will involve a simple brief letter in your postbox. If products ordered are on stock, will be picked up by the carrier the following working day. If ordered products are not on stock, we will contact you to let you know best available delivery date.

It is your responsibility that the ordered products can be received. Information about means of access must be provided when you place your order. We reserve the right to deliver at curbside or first entrance point if further delivery is impossible.

In case the packaging is damaged or have other visible indications of defects, remember to sign for receipt with reservations of potential damages of the products or refrain from receiving the delivery and ask the carrier to return the delivery to Swapkaart.

If a product is damaged or defect after unwrapping, please contact our sales support who will help find a solution. Due to proof of the faulty item please contact our sales support no later than 3 days after the receipt of the product. Please note that this does not affect your statutory rights.

All our online prices are based on providing carriage to European Union (EU) addresses only.  For delivery to addresses located outside the EU – please contact us for a delivery quotation at info@swapkaart.com so that we can fulfil your order.

AGE AND RIGHTS

You are entitled to replace one / all products you have purchased directly from our site within 14 days of receipt of the product.

The product should be in the same condition as when it was received. The product should also be in its original packaging with intact labels and protective stickers.

A product can only be exchanged for a product of the same value. If you want to switch to a more expensive or less expensive product, a return must be made and we will issue a full refund. After this, you may wish to place a new order for the right product.

WARRANTY AND ADVERTISING

The "Swapkaart" warranty applies for 1 month. The products are manufactured to meet our high-quality standards, in addition to the products covered by our warranty against manufacturing defects. To report a warranty case, contact customer service.

Note that the "Swapkaart" warranty does not cover:

Defects and damage caused by loss, theft, fire, or water.

Faults or damage caused by improper use, cravings (strokes, buckles, cuts, cases, etc.), accidents, or unjustified repair or modification.

Aesthetic changes, defects, and damage due to normal wear.

Failure to follow care instructions may void the warranty.

It is important that you as a customer carefully examine the item when you receive it. If your goods have been damaged during transport, you must report this to the carrier as soon as possible. This applies regardless of whether it is a visible injury or not. If after receipt of the product you find that it is damaged or does not correspond to your order, please contact us within 14 days.

Any complaints should be made to our customer service. Please provide us with your order number and the reason for your complaint and we will return with further instructions.

Wrong products returned to us should be treated with care by the customer. Whatever the reason for return, it is very important that the product is packaged so that it can not be damaged during transport. If a product is to be replaced, this is done against a product of the corresponding model. If a particular product is no longer available, the customer is entitled to repayment instead.

ORDER & PAYMENT TERMS

Eligibility to order products

You will need an active email address and a telephone number so that we can easily contact you.

All products sold through Swapkaart web shop are intended for domestic use only: products are not suitable for commercial or industrial use unless expressly stated.

Placing your order

Your order counts as an offer to purchase goods from us.

After placing your order, you will receive an Order Acknowledgement email within 1-2 working days (according to working schedule of the Netherlands). This contains details of the products you have ordered, the total cost of the order (including delivery) and an order number. It also constitutes the VAT receipt for your product(s).

Order acceptance

Acceptance of your order will take place when we despatch the product(s) to you. Until we despatch the product(s), no contract will have been formed between us.

Although we hope to be able to supply all products ordered, we reserve the right, at our discretion and without the need to give reasons, not to accept any offer at any time. If we refuse your order we will let you know as soon as reasonably possible.

Payment

You can pay with all major credit and debit cards.

We will take payment from your card at the time you place your order. Taking payment does not mean we have accepted your order and if for any reason we are unable to accept your order we will provide you with a full refund within 14 days.

Pricing

Unless otherwise stated all prices shown at Swapkaart web shop are inclusive of VAT, transportation costs and other applicable taxes. These prices are applicable only in for European Union deliveries. For product prices and deliveries for countries outside European Union, please contact us via email: info@swapkaart.com

We reserve the right to adjust prices, products and special offers at our discretion.

Pricing errors

If we discover an error in our pricing, we will inform you as soon as possible and you will then be given the option of cancelling or re-confirming your order at the correct price.

If for any reason we are unable to contact, you using the contact details you have provided we will treat the order as completed and notify you by email.

USER-GENERATED CONTENT

Our website may include user-generated content from, for example, social media. "Swapkaart" accepts no legal responsibility for such material. In case you suspect a copyright infringement, infringement of another right, or for any other reason, you would be offended by content posted on the website, please contact our customer service.

FORCE MAJEURE

In the event of war, warlike event, civil war, revolution, rebellion, government action, strike, lockout, blockade, natural disaster or similar event, technical problems, electrical/phone/data communications, or other communication errors and errors or delays in subcontracting services Due to circumstances stated herein, "Swapkaart" will be able to apply to force majeure. These circumstances shall constitute grounds for exemption which imply exemption from damages and other penalties. If this happens, we will try to inform the customer about this. "Swapkaart" reserves the right to make changes to these Terms at any time. Any changes to these Terms and Conditions will be published on the website. Changes are made to the acceptance of the Terms (in conjunction with a new purchase or visit to the website), or 10 days after we have informed you of the changes. However, "Swapkaart" recommends that you stay updated on the website regularly to be aware of any changes to the Terms.
